OVERVIEW
The Foleon Referral Program (“Referral Program”) may be entered into by Foleon Inc. (“Foleon”) and the referring party. By participating in this Referral Program, you agree to the following terms and conditions (“Referral Program Terms”), including without limitation our Privacy Policy.
You can review the most current version of the following term and conditions at any time on this page. We reserve the right to update, change or replace any part of these Referral Program Terms by posting updates and/or changes to our website.
Our campaign is available Worldwide.
ELIGIBILITY
Anyone may be a referrer in the program (“Referrer”) and invite their friends (“Invitee” or “Referral”), on the condition you are the age of majority in your state/jurisdiction/country of permanent residence.
In order for there to a qualified Referral, the following criteria shall be met as a whole:
- The Invitee shall be a new customer or potential customer to Foleon [A new customer does not include an organization who is a current customer or is already in negotiations to become a customer]
- The Invitee shall be the Manager or Director at the prospective organization, who works in either the Marketing/Sales or HR department.
- The Referral shall be made to an organization that is a B2B or Fortune 1000 BC.
- The Referral shall sign a contract with Foleon six months from the setup of the demo of the qualified Referral or the Referral shall schedule a demo with Foleon six months from the date of the qualified Referral.
REWARDS
The Referrer shall receive a reward (“Reward”) under two categories:
- Successful Demo:
- Referrer shall receive an amazon gift card worth $ 250 when a successful demo has been set up between Foleon and the Invitee
- Annual Subscription:
- Referrer shall receive an amazon gift card (worth $ 500 if the Invitee purchases the Start Plan or $ 1250 if the Invitee purchases the Scale Plan or higher) when the Invitee signs a contract and becomes a customer of Foleon with an annual subscription.
RESTRICTIONS
Exploitation of the Referral Program or assisting others to exploit the Referral Program is strictly prohibited and will result in disqualification from the Referral Program.
Referrers cannot refer themselves or an individual at the organization they work at.
BULK DISTRIBUTION (“SPAM”)
Each Referrer is the actual sender of the emails and must comply with applicable law. Referrals must be created and distributed in a personal manner that is appropriate and customary for communications with friends, colleagues and family members. By submitting any email address as part of the Referral Program, the Referrer represents that he/she has the appropriate permission and consent. Bulk email distribution, distribution to strangers, or any other use of the services described herein in a manner that is not promoted is expressly prohibited and may be grounds for immediate termination and further legal action. Foleon has no obligation to monitor the Referral Program or any communications; however, Foleon may choose to do so and block any email messages, remove any such content, or prohibit any use of the Referral Program. Referrers who do not comply with the law, including anti-spam laws, are obligated to indemnify Foleon against any liabilities, costs and expenses it incurs as a results of such spam.
MODIFICATION OR TERMINATION OF PROGRAM
The Referral Program is offered at the discretion of Foleon, and Foleon reserves the right to terminate, suspend, or modify the Program, these Referral Program Terms, the Rewards, conditions of participation, or any other aspect of the Referral Program, in whole or in part, at any time, with or without notice, even though such changes may affect Rewards already earned. You understand that the most recent version of the Referral Program Terms will be available on this page. Your continued participation in the Referral Program following any modification of these Referral Program Terms will indicate your acceptance of any modification to the Terms hereof. You may object to the modification to the Program and/or its Terms by no longer participating.
LIMITATION ON LIABILITY AND DISCLAIMER OF WARRANTIES
By participating in this Referral Program, you agree that Foleon and its agents, representatives, affiliates, officers, directors and employees will have no liability whatsoever for any injuries, losses, claims, damages or any special, exemplary, punitive, indirect, incidental or consequential damages of any kind, whether based in contract, tort, strict liability or otherwise, resulting from any use of the Program, any failure or delay by Foleon in connection with the Referral Program, or the performance or non-performance of the Referral Program by Foleon, even if Foleon has been advised of the possibility of damages. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation, computer virus, communications line failure, theft or destruction, or unauthorized access to, alteration of, or use of your information.
Foleon makes no warranty of any kind regarding the Referral Program, which is provided on an “as is” and “as available” basis. Foleon expressly disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade. Foleon is not responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Referral Program, including without limitation that the Referral Program will be error-free, or as to the accuracy, completeness and timeliness of any content or information distributed with respect to the Referral Program.
